Khodorkovsky and Lebedev’s submission to the ECHR

European Court for human rightsFurther to an announcement and publication of a summary of the submission filed by lawyers for Mr Khodorkovsky and Mr Lebedev with the European Court of Human Rights in Strasbourg on 16 February 2015, and given the widespread and continued interest in this case, we now publish the submission to the court’s questions and Russian Federation’s observations in full.

Notably, following this submission, the court has invited the Russian Federation to submit further observations by 16 April 2015.

Please note that the submission was filed in English only. However, for convenience and ease of reference of our Russian speaking readers we provide an unofficial Russian translation.

The submission relates to the application that Mr Khodorkovsky and Mr Lebedev had made to the European Court (applications were originally lodged in 2007) in which they complained that their second trial in 2009-2010 was fundamentally unfair and that their convictions were unlawful. The document is filed in response to a remarkably detailed set of questions that the Court had in March 2014 asked the Government of Russia to answer about the complaints that had been made. In September 2014 the Court asked Mr Khodorkovsky and Mr Lebedev to respond to the Government’s Memorandum.
